Clean Elections Solicits Comment on Proposed Voters Right to Know Act Rules

Passed by voters in 2022, Proposition 211 establishes more campaign spending disclosure

Clean Elections, Arizona’s nonpartisan election agency, is soliciting public comment on the first round of proposed rules implementing the Voters Right to Know Act, or Proposition 211.

More than 70 percent of voters approved the act at the 2022 general election. The measure imposes certain disclosure requirements on organizations that engage in campaign media spending above particular monetary thresholds. Proposition 211 authorizes the Clean Elections Commission to make rules regarding implantation of its provisions. The Commission is a five- member, nonpartisan board that administrates campaign finance and voter education for Arizona.

The first set of proposed rules includes procedures for donors who believe they face harm from disclosure of their identities to seek protections, notifying donors of their right to opt out of having their funds used for campaign media spending, and disclaimers that must appear on campaign literature and advertising.

The 60-day public comment period was initiated in June and runs through August 22. The Commission takes oral comment from the audience (both in-person and via an online meeting platform) at its public meetings regarding rule proposals. The first meeting the Commission may consider adopting the rules is currently scheduled for August 24 at 9:30 a.m. Arizona time.

A second set of proposed rules relating to enforcement proceedings is also available for public comment and will be eligible for consideration in September.
