A public meeting of the Citizens Clean Elections Commission was convened on
August 7, 2001 at 5:30pm at the Citizens Clean Elections Commission, 4001 N. 3rd Street, Suite 200, Phoenix, Arizona 85012, pursuant to public notice duly given.

- Chairman Lemon called the meeting to order at approximately 5:30 p.m.
- Approval of the July 10, 2001 minutes:
Commissioner Detrick moved to approve the July 10, 2001 minutes, seconded by Commissioner Lopez, the July 10, 2001 minutes were approved as presented. Motion carried.
- Executive Director’s Report:
Announcements:
Brian Finell and Robert Simpson from the Secretary of State’s office will be working with Deputy Director Matt Shaffer in developing the campaign software for 2001-2002 election cycle.
Five Dollar Bill’s debut is scheduled in Cottonwood, Arizona on October 6, 2001. The event will feature a parade and chili cook off.
The Commission will receive a preliminary copy of the Auditor General’s report by the end of August 2001.
The campaign finance seminars will begin on August 22, 2001. Five different dates have been established for these seminars:
August 22, 2001
September 19, 2001
October 10, 2001
November 14, 2001
December 19, 2001

Voter Education:
Karen Osborne, Maricopa County Elections Director, will be at the August 21, 2001 Commission meeting. She will present a preliminary estimate for Maricopa County to produce the candidate statements.
Rules:
Public comments on Amendments to Article 1 and the consideration of substantive policy statements will be discussed in the August 21, 2001 Commission meeting.
- Consideration and Approval of Projections for Clean Elections Fund for 2002
Election:
Deputy Director Matt Shaffer presented to the Commission, for their consideration, four different case scenarios regarding the potential outcomes of candidate campaign funding for the 2002 election cycle,
- Not quite the worst case
- The worst case
- The best case
- The expected case
Commissioner Ruth Jones stated that there is not enough data, at this point in time, in order to adopt a projection.
Commissioner Detrick stated that the Commissioners and the public should continue to be as positive as possible and continue to encourage participation.
Lee Miller of Miller, LaSota and Peters posed two questions to the Commissioners regarding the concept of deficit spending.
Tim Casey encouraged the Commission to come to a decision sooner rather than later in regards to funding candidates.
David Eagle commented that he felt that the majority of funding should be focused on the General Election and that CCEC would generate more revenue to meet the funding needed in the General Election.
- Legal Report (Oral Report from Assistant Attorney General Todd Lang).
Todd Lang, Assistant Attorney General, reported in the Lavis v Bayless lawsuit that motions were filed for summary judgments. Both sides have filed. The responses are due the end of August 2001. The replies are due in the early part of September 2001.
Oral argument will be scheduled sometime thereafter. Hopefully, there will be a resolution to this case by the end of 2001.
He is working on the Department of Justice pre-clearance, and has a response to Articles 1 & 2.
Todd Lang is working on the rules regarding express advocacy and continuing to work on A.R.S. §16-956, the procedure for the printing of pamphlets, and A.R.S. §16-954, funding projections.

Mr. Miller has a concern about the $5.00 qualifying contribution forms being submitted electronically through the internet He feels this form of collection should be allowed as a valid way to collect qualifying forms.

Commissioner Carl Lopez moved that the Commission meeting be adjourned, seconded by Commissioner Detrick. Motion carried.
