MINUTES OF PUBLIC MEETING OF THE

STATE OF ARIZONA

CITIZENS CLEAN ELECTIONS COMMISSION

MAY 31, 2001

A public meeting of the Citizens Clean Elections Commission was convened on May 31, 2001 at 9:30am at the Citizens Clean Elections Commission's Office, 4001 North 3rd Street, Suite 200, Phoenix, Arizona, pursuant to public notice duly given.

  1. Chairman Lemon called the meeting to order at approximately 9:30 a.m.
     
  2. Approval of the May 15, 2001 meeting minutes:

    Commissioner Jones moved to approve the May 15, 2001 minutes as distributed, seconded by Commissioner McKay, the May 15, 2001 minutes were approved. Motion carried.

  3. Executive Director's Report:

    Announcements:

    • Colleen Connor introduced the Commission's Summer Administrative Intern, Laurie Kalivas to the Commission.
    • Lobbyist fees received to date are $24,000.00.

    Marketing and Public Relations:

    • Joe Jacober and Robert Johnson would present the following later in the meeting for the Commission's consideration:
      1. "Five Dollar Bill's hometown (CPR presentation)
      2. The "Five Dollar Bill" Icon
      3. Key Project Objectives

    Candidate Statements:

    • On May 30, 2001, Director Connor met with Karen Osborne, Maricopa County Elections Director, and Jill Kennedy, County Attorney's Office, to discuss the development of a procedure for candidate statements. The meeting was in preparation of the annual County Recorders meeting on June 7, 2001.
    • In March, Jill Collins had sent a letter to all County Recorders requesting them to consider the development of a procedure to mail the candidate statements with the early and sample ballots.
    • Because Maricopa County feels that it will be impossible to place candidate statements in the early and sample ballots, Osborne and Kennedy suggested that the Commission do a separate brochure for each legislative district to include all the statewide offices and that particular district.
    • The Executive Director will attend the June 7, 2001 Annual County Recorders meeting to discuss the matter with all of the counties.
    • Colleen Connor will report the consensus of all counties to the Commission at its next meeting, June 19, 2001.

    Debates:

    • The State Procurement Office has finalized the Request for Proposal (RFP).
    • The RFP will be provided to the Commission at the next Commission meeting for the Commission's consideration and approval.
    • At that time, we will also consider the committee to review the bids. The bids from those interested in sponsoring the debates must remain confidential except from those serving on the selection committee. Therefore, one consideration is whether one of the Commissioners would like to serve on the selection committee which will be a big time commitment, or delegate the selection to staff.

    Budget:

    • The lobbyist fee enforcement responses are continuing to be received by the office. To date, the Commission has received approximately $24,000 from the enforcement.
    • The fund will reach $9 million dollars by the end of this month and $10 Million by the end of next month due to the success of the $5 tax check-off campaign.
    • Mark Osterloh wrote a letter concerning the amount of money the fund will have in 2002. Because we do not know how many candidates there will be and our projections of the number of candidates show that there will be enough money, it appears too early to reconsider the campaign fund projections for 2002.

    Rules:

    • The final set of rules for consideration are the substantive amendments to Article 1.

  4. Approval of Advertising and Public Relations Campaign:

    Joe Jacober, L3 Creative, and Robert Johnson, Critical Public Relations (CPR), gave a report to the Commission regarding the Public Relations Campaign and "Five Dollar Bill".

    Commissioner Jones moved to accept Cottonwood, Arizona as the city to introduce "Five Dollar Bill" and his hometown, seconded by Commissioner Lopez. Motion carried.

    Commissioner Lopez moved to accept the direction of L3 Creative and CPR, on the development of "Five Dollar Bill", seconded by Commissioner McKay. Motion carried.

    Commission Lopez moved to approve the three key project objectives for the public relations campaign, seconded by Commissioner McKay. Motion carried. The three key objective are as follows:

    1. Increase awareness of CCEC and its role around the State.
    2. Increase the $5 tax credit contributions (check box) via State tax forms by 50%.
    3. Increase individual dollar-for-dollar contributions (up to $500/20% of State tax amount) by taxpayers.

  5. Review Public Comments and Approval of Amendments to Article 1 of the Rules

    • Chairman Lemon reviewed the proposed amendments to Article 1.
    • Lee Miller addressed the Commission with questions regarding the proposed changes to A.A.C. R2-20-105 (C). Specifically, that the rule not be limited to the candidate to use direct mail to solicit qualifying contributions. Mr. Miller further commented on the rule regarding express advocacy, A.A.C. R2-20-109 (D).
    • The Commission adopted two rules as alternatives for A.A.C. R2-20-109 (D).

    Commissioner Lopez moved to adopt Article 1 with the current changes, seconded by Commissioner McKay. Motion carried.

  6. Legal Report

    Joe Kanefield, Assistant Attorney General, had nothing to report.

  7. Public Comment:

    None.

    Commissioner Lopez moved to go into executive session to discuss Personnel issues, seconded by Commissioner McKay. Motion carried.

    Commissioner Jones moved to adjourn both the executive session and the Commission meeting, seconded by Commissioner McKay. Motion carried.
