CITIZENS CLEAN ELECTIONS COMMISSION
MAY 15, 2001
A public meeting of the Citizens Clean Elections Commission was convened on
May 15, 2001 at 9:30am at the Citizens Clean Elections Commission's Office, 4001 North 3rd Street, Suite 200, Phoenix, Arizona, pursuant to public notice duly given.

- Chairman Lemon called the meeting to order at approximately 9:35 a.m.
- Approval of the April 24, 2001 meeting minutes:
Commissioner Jones moved to approve the April 24, 2001 minutes as distributed, seconded by Commissioner McKay, the April 24, 2001 minutes were approved. Motion carried.
- Director's Report:
Announcements:
- The annual COGEL conference will be held in Lexington, Kentucky from December 2 - 5, 2001. Commissioner Jones and Chairman Lemon will be panelists. Dottie Eggleston will make travel arrangements.
- The Election Officer Certification classes will be held in June and August. Matt Shaffer and Colleen Connor will be attending this weeklong workshop.
- The Arizona Economic Forum will meet in Flagstaff from June 14-16, 2001. Election issues will be discussed in the morning sessions.
- A new administrative intern has been hired. Her name is Laurie Kalivas. Ms. Kalivas will start her position on Monday, May 21, 2001.
- Lobbyist Fee letters were sent out on May 11, 2001. A comprehensive report will be given at the next Commission meeting.
Rules:
- Articles 1 & 2 of the rules package are complete.
- Articles 3 through 7 were filed and will be published in the Arizona Register.
Voter Education:
- Jill Collins, Public Relations and Voter Education, has created a brochure about Clean Elections.
- Review Public Comments and Approve Articles 1 & 2 of the Rules
- Chairman Lemon went through each section of Articles 1 & 2.
- The Commission reviewed the technical changes suggested by the Public Comment to Articles 1 and 2.
- Attorney Lee Miller addressed the Commission with questions and feedback regarding Article 1, A.A.C. R2-20-101, The definitions of expressly advocates.
- Because substantive changes may be required, the Commission will review proposed amendments to A.A.C. R2-20-104, certification as a participating candidate, and A.A.C. R2-20-109, reporting requirements, at the May 31, 2001 Commission meeting.
Commissioner Jones moved to accept Article 1 with the current changes, with the substantive changes to be approved in the May 31st Commission meeting, seconded by Commissioner McKay. Motion carried.
Commissioner Detrick moved to adopt Article 2 as presented, seconded by Commissioner McKay. Motion carried.
Chairman Lemon stated that the rules adopted in the May 15, 2001 meeting are in effect and will be subject to Justice Department approval. The rules will be in effect until any substantive changes are approved.
The Commissioners were given two forms to approve:
- Application for Certification
- Qualifying Contribution Form
Sharlene Bozack, Clean Elections Institute, addressed the Commission with questions regarding the application for certification form requiring the certification prior to a candidate accepting qualifying contributions.
Commissioner Jones moved to adopt the forms as modified, seconded by Commissioner Detrick.
Motion carried.
- Consideration of the Procedure for Electronic Transfer of Funds:
- Matt Shaffer, Deputy Director, discussed the State's procedures for setting up and processing warrants using electronic transfer. At this point, the process to setup the electronic transfer of funds takes much longer than the normal process of setting up a vendor.
- Discussion of Strategic Planning:
The Commission considered the action plans. The staff will continue to work on Strategic Planning and incorporate the changes suggested by Commissioner Jones.
Commissioner Jones requested all styles for Strategic Planning be consistent.
- Consideration of Personnel to work on Enforcement Matters:
A conceptual framework for a team to work on enforcement matters was presented.
- Approval of Revised Meeting Schedule.
Commissioner McKay moved to adopt the meeting schedule as presented, seconded by Commissioner Detrick. Motion carried.
- Legal Report
Todd Lang, Assistant Attorney General, reported that he is continuing to work on the lawsuit filed in state court by Representative Steve May and Lobbyist Rick Lavis; Lavis v.Bayless.
- Public Comment:
Marge Mead - League of Women Voters and Clean Elections Institute
Ms. Mead will present information on Clean Elections to the League of Women Voters meeting in Tucson, Arizona on Sunday, May 20, 2001.
- The next meeting is Thursday, May 31, 2001, 9:30 a.m., Citizens Clean Elections Commissions, 4001 N. 3rd Street, Suite 200, Phoenix, Arizona

Assignments:
Deputy Director Shaffer will investigate what processes in the setup of electronic transfer of funds can be improved.
Director Connor will be developing plans for an enforcement team and drafting rule amendments.
The staff will track the implementation of Strategic Planning.
Commissioner McKay moved to go into executive session to discuss litigation matters, seconded by Commissioner Jones. Motion carried.
Commissioner McKay moved to adjourn both the executive session and the Commission meeting, seconded by Commissioner Jones. Motion carried.
