A public meeting of the Citizens Clean Elections Commission was convened on Tuesday November 18, 2003, 9:30 a.m., at Citizens Clean Elections Commission, 1616 W. Adams, Suite 110, Phoenix, Arizona 85007

  1. Chair Lemon called the meeting to order at approximately 9:30 am.

    Chair Lemon stated that Commissioner Detrick was absent due to the City of Tucson’s Election.

  2. Approval of Minutes of October 21, 2003 Meeting

    Commissioner Busching moved to approve the October 21, 2003 minutes. Commissioner Jolley seconded. Motion carried.

  3. Executive Director’s Report

    • Eric Gorsegner started as Deputy Director on Monday, October 27, 2003.
    • Staff is developing the computer program for the candidate statement pamphlet
    • The Fund balance at the end of October was $13,989,006
    • Candidate Statement Pamphlet: Contract for the graphic designer to be awarded by State Procurement Office by December 1, 2003.
    • Three candidate training classes have been held to date: Two in Phoenix and one in Tucson. Next training class will be held in Phoenix on December 10, 2003.
    • Deadline for debate sponsor applications was October 31, 2003. Eleven organizations filed applications. Staff is in the process of reviewing the applications.
    • Autumn Southard, Voter Education Manager, has been to various speaking engagements and events, including: Mesa Rotary Club, National Hispanic Women’s Conference, and the Arizona State Fair’s Government Days.
    • The administrative hearing for Yuri Downing, the Libertarian candidate from District 17, is schedule for three more days of testimony, December 3, 8, and 9th.
    • Sent letters to two candidates for payment of their outstanding civil penalties. One has responded with payment in full and the other has set up a payment plan.
    • Staff developed the Commission’s proposed 2004 budget and projected revenue for the next four years. Both items are on today’s agenda.

  4. Approval of Commission Meeting Schedule for January-June 2004

    After reviewing the proposed Commission meeting schedule for January-June 2004, Commissioner Busching moved to accept the schedule. Commissioner Jolley seconded. Motion carried.

  5. Consideration and Approval of the Following Fiscal Matters:

    1. 2004 Budget of Revenues and Expenditures.

      Chair Lemon entertained a motion to approve the proposed 2004 budget with one modification; to increase the amount budgeted for candidate campaign funds by $1 million. Commissioner Jolley moved to accept the 2004 budget as modified. Commissioner Detrick seconded. Motion carried.

    2. Fund Revenue Projections for Next Four Years. A.R.S § 16-954 (D).

      The projected annual growth for the Commission’s revenues over the next four years is 3%. Based on that projection, the Commission will give $3,825,577 to the state general fund pursuant to A.R.S. §16-954(D).
      Commissioner McKay moved to accept the projection. Commissioner Detrick seconded. Motion carried.

  6. Consideration of Proposed Legislative Rule Changes

    The Commission approved the following rule revisions as discussed at the October 2003 meeting with the noted changes.

    R2-20-103 Computation of Time
    R2-20-104 Certification as a participating candidate
    R2-20-107 Use of Public Funds
    R2-20-109 Reporting requirements
    R2-20-111 Bookends and records requirements
    R2-20-112 Inaugural expenses
    R2-20-113 Calculation of matching funds
    R2-20-203 Complaints
    R2-20-205 Opportunity for no action on complaint-generated matters
    R2-20-206 Executive Director’s recommendation on complaint-generated matters
    R2-20-208 Complaint processing notification
    R2-20-212 Services of subpoenas, orders and notifications
    R2-20-113 Calculating matching funds
    R2-20-214 Probable cause to believe recommendation; briefing procedures
    R2-20-217 Enforcement proceedings
    R2-20-218 Public disclosure of Commission action
    R2-20-223 Notice of appeal able agency action
    R2-20-229 Debates sponsored by the Commission
    R2-20-230 Exemption from participation in debate

    Commissioner Busching moved to accept the proposed rule changes as revised. By the Commission’s approval of the rule changes, the 60-day public comment period began. Commissioner McKay seconded. Motion carried.

  7. Legal Report from Assistant Attorney General Diana Varela

    Assistant Attorney General Diana Varela reported that the Yuri Downing administrative hearing is continued for three more days in December.

    Litigation regarding the 2004 legislative districts has begun. The Independent Redistricting Commission was given $1.7 million dollars to defend the current maps. The current maps for the 2004 election have been pre-cleared by the US Department of Justice.

    In Arizona Right to Life v. Brewer, the Arizona Right to Life has filed a notice of appeal and their brief is due in February 2004. They have also filed a motion to vacate the judgment.

  8. Call for Public Comment

    Commissioner Busching complimented the recent advertisement in the newspaper regarding tax credit donations.

  9. Agenda Items for the Next Meeting on Tuesday, December 16, 2003, 9:30a.m:

    • Nomination and Election of a Commission Chairperson for 2004
    • Consideration of Debates Sponsor Applications
    • Update on accounting firm contract
    • Update on Secretary of State’s progress in choosing a new Commissioner
    • Public Relations projects

  10. Adjournment

    Commissioner McKay moved to adjourn the Commission meeting. Commissioner Detrick seconded. Motion carried.
