MINUTES OF PUBLIC MEETING OF THE

STATE OF ARIZONA

CITIZENS CLEAN ELECTIONS COMMISSION

July 22, 2003

A public meeting of the Citizens Clean Elections Commission was convened on July 22, 2003, 9:30 a.m., at Citizens Clean Elections Commission, 1616 W. Adams, Suite 110, Phoenix, Arizona 85007

  1. Commissioner McKay called the meeting to order at approximately 9:30 am.

    In the absence of Chair Lemon, Commissioner McKay was acting Chaiperson for this meeting. Commissioner McKay acknowledged that Commissioner Detrick was not present and that Commissioner Lemon was present telephonically.

  2. Approval of Minutes of June 24, 2003 and June 30, 2003 Meeting

    Commissioner Busching moved to approve the June 24, 2003 meeting minutes. Commissioner Lemon seconded. Motion carried. Commissioner Lemon moved to approve the June 30, 2003 meeting minutes. Commissioner Busching seconded. Motion carried.

  3. Executive Director’s Report

    • Assistant Attorney General, Todd Lang’s last day will be July 25, 2003. Diana Varela, Assistant Attorney General, will be representing the Commission.
    • Campaign Finance Analyst, Matthew Turner, has joined the Secretary of State’s Office. He will assist candidates and treasurers with campaign finance software questions.
    • Staff, not including administrative support staff, has completed and passed the Arizona election officer certification and training program.
    • The fund balance at the end of June was $11,744,451.
    • The Act, Rules and Policy Manual has been updated.
    • The 3 Libertarian candidates from District 17 who were ordered to repay their Clean Elections funding have requested an appeal. The administrative hearings will be held August 22, 2003 at the Office of Administrative Hearings.
    • Staff continues to work with the accounting firm, Sarvas, King & Coleman to finalize the random audits from the post-general report.
    • Public relations and speaking engagements have been scheduled for the next few months.
    • Autumn Southard, Voter Education Manager, has done a survey for all the candidates in the 2002 election regarding their impression of the debates and the candidate statements pamphlets.
    • Executive Director Connor, and Paula Ortiz, Executive Assistant, continue to work with the State Procurement Office with regards to the RFP and to find sponsors for the 2004 debates.
    • Barclay Communications has completed the telephone survey questions.
    • The key project objectives for the advertising and public relations campaign are on the agenda.
    • Congressman Jeff Flake had requested an advisory opinion from the Federal Elections Commission regarding his role in a statewide initiative to repeal Clean Elections. Last week the FEC rendered their opinion. There is no written opinion as of yet. Mr. Flake is permitted chair the committee with restrictions.

  4. Discussion Regarding Performance Criteria of Scope of Work for Auditing Contract and Auditor for 2004

    The Commission requires the services of a certified public accounting firm, currently licensed in the State of Arizona to provide auditing services for the 2004 election cycle on an as needed basis, of participating and nonparticipating candidate campaign finance reports. After brief discussion, Executive Director Connor would incorporate the changes and submit the revision at the revised Scope of Work at the August 19, 2003 Commission.

  5. Discussion Regarding Performance Criteria for Advertising and Public Relations Campaign

    Bill Mayhall, Barclay Communications, explained to the Commission and reviewed what has been accomplished in the last 60 days. In order to build awareness, Barclay communications has scheduled 23 speaking engagements. Beginning in August, Barclay will begin scheduling and speaking in high schools and community colleges. Displays have been ordered for speaking engagements and civic events. In terms of media relations, Barclay has secured 3 talk radio interviews and have also secured 2 print interviews. Polling is currently taking place and results will be available July 25, 2003. Barclay has completed 2 civic events: Tempe Downtown Cooldown and The Fabulous Phoenix Fourth, which were very effective in educating the public about CCEC.

    The Commission agreed that the $5 tax check- off and the voluntary tax donations will be under the scope of #1, which is Increasing Awareness of CCEC and It’s Role around the State of Arizona.

    Therefore, the two Key Project Objectives to be accomplished in the Education Campaign are:

    1)   Increase awareness of CCEC and it’s role around the State of Arizona, which would include the $5 check-off and voluntary tax donation.

    2)   Training candidates and their organizations on the campaign finance requirements and laws

  6. Discussion of Commissioner and Staff Attendance at COGEL Meeting September 21-24, 2003 in Austin, Texas

    The Commissioner who attended the meeting in the past suggested that Executive Director and staff attend the COGEL meeting on a rotating basis along with the Commissioners. Commissioner McKay suggested that Executive Director Connor make the decision as to which staff members attend.

  7. Legal Report from Assistant Attorney General Todd Lang

    Assistant Attorney General, Todd Lang, reported that Rule 105 has been submitted with changes regarding the increase of the number of slips to the Department of Justice. There will be a deposition Thursday, July, 24, 2003 regarding the three Libertarians from District 17. The 2 lawsuits challenging Express Advocacy are still pending.

  8. Call for Public Comment

    There was no public comment.

  10. Commissioner Busching moved to go into Executive Session for Performance Evaluation of Executive Director Connor. Commissioner Jolley seconded. Motion carried.
     
  11. Adjournment

    Commissioner Lemon moved to adjourn the Commission Meeting. Commissioner Busching seconded. Motion carried.
