MINUTES OF PUBLIC MEETING OF THE

STATE OF ARIZONA

CITIZENS CLEAN ELECTIONS COMMISSION

December 10, 2002

A public meeting of the Citizens Clean Elections Commission was convened on December 10, 2002, 9:30 a.m., at Citizens Clean Elections Commission, 4001 N. 3rd Street, Suite 200, Phoenix, Arizona 85012

  1. Chairperson Jones called the meeting to order at approximately 9:34 a.m.
     
  2. Meeting Minutes.

    Commissioner Jolley requested that the November 19, 2002 minutes be revised to reflect that she voted against the mostion on the Mark Clark enforcement matter. Commissioner McKay moved to approve the November 19, 2002 minutes, with Commissioner Jolley's revision, seconded by Commissioner Detrick. Motion carried.

  3. Executive Director's Report:

    • Staff is reviewing post general finance reports to determine compliance and the amount of any general election unspent monies to be returned to the fund.
    • Staff continues to work with Secretary of State-elect Jan Brewer to ensure a smooth transition.
    • Executive Director, Colleen Connor continues to participate in the legislative working-group discussions with Secretary of State Betsey Bayless and others regarding possible legislative changes to the Act.
    • Commission approval of the job descriptions for the Deputy Director and Voter Education positions.
    • Governor-elect Janet Napolitano will make the next Commission appointment for the term beginning February 1, 2003.
    • Troy Corder and Carlton Hawkins are working with staff on the advertising for the voluntary donations and the $5 tax check off.
    • Individuals who, in the past, have participated in the voluntary tax credit donation program were sent letters reminding them that the 2002 donation must be made by December 31, 2002.
    • Executive Assistant Paula Ortiz and Executive Director Connor will meet with ASU representatives to discuss the 2002 debates and tie up any loose ends.
    • The Salmon for Governor Committee responded to the preliminary audit report. Debi Tobin from Fields, Sarvas, King & Coleman is in the process of finalizing the final audit report.
    • Staff conducted an analysis of the enforcement matters in response to criticism that staff was partisan regarding enforcement. The analysis confirmed that there was no partisan slant.

  4. Nomination and Election of the Commission Chairperson for 2003

    Commissioner Lemon nominated Commissioner Detrick as the 2003 CCEC chairperson. Commissioner Detrick respectfully declined due to other commitments and nominated Commissioner Lemon. Commissioner McKay seconded. Motion carried.

  5. Approval of 2003 Commission Meeting Schedule

    Commissioner Lemon requested that the April 22, 2003 meeting be changed to April 29, 2003. Commissioner Detrick moved to adopt the schedule with the April 29, 2003 meeting change. Commissioner McKay seconded. Motion carried.

  6. Consideration and Approval of the Following Fiscal Matters:

    1. Commission Budget of Revenues and Expenditures for 2003: After discussion, Commissioner Jolley moved to accept the budgeted revenues and expenditures for 2003. Commissioner McKay seconded. Motion carried.
    2. Fund Revenue Projections for Next Four Years A.R.S. 16-945(D) : After discussion, the Commission requested that Assistant Attorney General Todd Lang review revenue projections for discussion at the January 2003 Commission meeting.
    3. Adjusting Number of Qualifying Contributions A.R.S. 16-956(E): After discussion, Commissioner Lemon motioned that the Commission tentatively approve an increase of the number qualifying contributions by five percent, instructed staff to seek public comment on a proposed increase. Commissioner Detrick seconded. Motion carried.
    4. Reallocating Spending Limits. A.R.S. 16-959(B): After discussion, the Commission declined to make any changes to the spending limits.

  7. Discussion of Proposed Legislative Changes

    Chairperson Jones verified with Executor Director Connor that the proposed legislative changes were for discussion purposes only.

  8. Consideration of Request for Advice Regarding Inaugural Expenses

    On behalf of Governor-elect Janet Napolitano, Scott Bales requested advice regarding Commission Rule R2-20-112. In the event that the committee organized for the Governor-elect Napolitano's inaugural has money left over, can the left over funds be donated to domestic-violence shelters within Arizona rather than being donated to the Fund as provided in R2-20-112(B).

    Commission Lemon asked Executive Director Connor for her recommendation. Ms. Connor stated that because of the current Commission rule, any excess money must be donated to the Fund. However, she stated that the Commission may want to review the inaugural expenses rule at a later date. Furthermore, Ms. Connor explained that there were no prohibitions or limit on funding for inaugural expenses. Commissioner McKay moved to accept Ms. Connor's recommendation . Commissioner Detrick seconded. Motion carried.

  9. Legal Report

    Solicitor General Mary O'Grady addressed the Commission on behalf of Assistant Attorney General Todd Lang. Ms. O'Grady reported that in May v. Bayless a petition for certiorari is expected to be filed in early January.

  10. Call for Public Comment

    No public comment.

  11. Adjournment

    • Commissioner Lemon moved to adjourn the meeting. Commissioner McKay seconded.
      Motion carried.
