- Chairperson Jones called the meeting to order at approximately 9:40 a.m.
- Meeting Minutes.
As revised by Commissioners McKay and Lemon, Commissioner Lemon moved to approve the August 27, 2002 minutes, seconded by Commissioner McKay. Motion carried.
As revised by Commissioner Lemon, Commissioner McKay moved to approve the September 4, 2002 minutes, seconded by Commissioner Detrick. Motion carried.
- Executive Director's Report:
Announcements:
- Commissioner Lemon will represent the Commission on September 25, 2002 at 10:00 a.m. at the State Capital at a press conference in coordination with the Secretary of State and the Supreme Court to recognize Sun Sounds, which will be providing the publicity pamphlets, judicial performance review and the Candidate Statement Pamphlet in alternate formats for the visually impaired and disabled.
- Executive Director recognized the Clean Elections staff for doing an excellent job with planning the debates, issuing checks, and completing the candidate statement pamphlets for the general election in a very limited amount of time.
- Welcoming the addition of Christina Jones to the Clean Elections Staff.
- Commissioner Lemon announces that Chair Jones has been elected to the board of trustees for the Campaign Finance Institute in Washington D.C.
Voter Education:
- The general election pamphlets are completed and were sent to the printer on September 16, 2002.
- A copy of the pamphlet will be mailed to every household with a registered voter, which is approximately 1.4 million Arizona households, for the start of early voting, October 3, 2002. The general election pamphlet will be available in Spanish, large print, and audio tape.
- The schedule of the general election candidate debate is completed.
- Arizona State University, CPR, and the community colleges are continuing to work together on advertising and publicizing the general election debates.
Enforcement:
- The staff is continuing to review complaints and internally generated matters.
- The staff is reviewing the pre primary reports filed be participating candidates to ensure that the participating candidates spent all of their early contributions and if not that the excess be returned to the fund. Staff is also reviewing reports to ensure that the participating candidates have not exceeded their personal money limits. Further, staff has notified all participating candidates in the primary election that any unspent money must be returned to the Clean Elections Fund.
- In the case of Cheuvront vs. CCEC, the judge denied Mr. Cheuvront's request for an injunction and upheld the Commission's decision that Mr. Cheuvront's mailing sent in June was campaign- related.
Budget & Office Operations:
- 170 candidates have moved forward to the general election and 89 of them are participating candidates.
- Total funding disbursed for the primary elections was $7,477,642.00, approximately $2 million less than the projected amount for primary election funding. The amount projected for primary election funding was $ 9.8 million.
- So far, disbursements for the general election total $2,679,081.00, which includes matching funds of over $100,000.00 to date.
- Amount projected for disbursement for the general election was $7,751,040.00
- The ending balance as of August 31, 2002 was $11,570,344.00.
- The balance to date, September 24, 2002, is $8,670,726.00, which includes $74,000.00 that was returned from the candidates from the primary election.
- Consideration of Proposed Settlement Agreements
- Russell Pearce
Mr. Pearce who was originally opposed in his primary election then became unopposed, was ordered to cease all spending and to provide an accounting to the Commission of his disbursements and expenditures. Mr. Pearce has provided such an accounting and also remitted all unspent funds to the Commission, which was approximately $5,000.00.
Executive Director Colleen Connor recommended that the Commission approve the settlement agreement. Commissioner McKay moved that the settlement in the Russell Pearce agreement be approved. Commissioner Detrick seconded the motion. Motion carried.
- MUR#02-0027-Debra Gullett, a candidate for State Representative- District 11.
Commissioner McKay recused himself from the discussion and participation in this matter.
On August 27, 2002, the Commission had found reason to believe that Ms. Gullett had violated the reporting requirements in the Act. Todd Lang, Assistant Attorney General, recommended that the Commission enter into settlement agreement with the Ms. Gullett for a $1,000.00 civil penalty. Commissioner Jolley moved to accept the proposed settlement agreement. Commissioner Detrick seconded the motion. Motion carried.
- Legal report from Assistant Attorney General Todd Lang.
Mr. Lang reported that he continues to work on enforcement matters. Mr. Lang also reported that the Attorney General's Office is writing an amicus brief regarding the 5th Circuit's ruling
in Chamber of Commerce vs. Moore because the State of Mississippi has filed a petition for
certiorari in the Supreme Court.

Commissioner McKay moved to adjourn the Commission meeting, seconded by Commissioner Detrick. Motion carried.
