MINUTES OF PUBLIC MEETING OF THE

STATE OF ARIZONA

CITIZENS CLEAN ELECTIONS COMMISSION

July 30, 2002

A public meeting of the Citizens Clean Elections Commission was convened on Juy 30, 2002, 9:30 a.m., at Citizens Clean Elections Commission, 4001 N. 3rd Street, Suite 200, Phoenix, Arizona 85012

  1. Chairperson Jones called the meeting to order at approximately 9:35 a.m.
     
  2. Approval of the July 3, 2002 (Emergency Teleconference Session) and July 30, 2002 minutes:

    Commissioner McKay moved to approve both the July 3, 2002 and July 30, 2002 minutes as presented, seconded by Commissioner Lemon, the July 3, 2002 and July 30, 2002 minutes were approved as presented. Motion carried.

  3. Executive Director's Report:

    Voter Education:

    • Candidate Statement Pamphlet
    • Candidate Debates

    Enforcement:

    • Candidate committees selected for audit
    • Two complaints are in process
    • Repayment of clean elections funding
    • Horne v. Molera

    Budget & Office Operations:

    • The fund has approximately $l5.28 million
    • To date, the Commission has refunded about $132,700 to lobbyists

    Troy Corder, Critical Public Relations, gave a brief overview of the debate schedule. KAET TV (Channel 8) will be hosting and televising most of the Statewide and a third of the Legislative debates.

  4. Consideration and Decision Regarding Repayment of Clean Elections Funding After Candidates' Status Change from Opposed to Unopposed.

    Executive Director Connor gave an overview of the request for repayment of campaign funds from candidates who were formerly opposed in their district race and are now unopposed. She also made a recommendation to the Commissioners.

    Commissioner Lemon recommended that the unopposed candidates for office cease spending funds, terminate all commitments, contracts and obligations, provide an accounting of monies spent and remit unspent campaign funds to the Commission.

    Executive Director Connor reviewed the following order for the Commission:

    As of June 27, 2002, when the election for State Representative for District 18 became an unopposed election, the candidates are hereby ordered to:

    1. Cease spending of primary elections funding;
    2. Terminate commitments, contracts, or obligations made prior to June 27,2002, if the penalty for canceling the contract is less than the amount due for full performance of the contract;
    3. Provide an accounting to the Commission within 20 days of this letter for all disbursements, expenditures, debts or obligations of primary elections funding; and
    4. Remit all unspent funds to the Commission.

    Commission Lemon moved to approve the order as presented, seconded by Commissioner McKay. Motion carried.

  5. Disscussion of Commissioner and Staff Attendance at COGEL Meeting September 29, 2002 through October 29, 2002:

    Executive Director Connor will decide which staff members will attend the COGEL conference.

  6. Discussion and Consideration of Adjusting qualifying Contribution Amounts and Spending Limits After 2002 Election:

    Executive Director Connor reviewed this issue with the Commissioners. It will be discussed at the August 13, 2002 Commission meeting.

  7. Legal Report from Assistant Attorney General Todd Lang:

    Attorney General Todd Lang is continuing to work on the oral argument to be presented to the Supreme Court on August 8, 2002 in the case pending before the court.

  8. Call for Public Comment:

    Jessica Funkhouser, Secretary of State, State Election's Director:

    Ms. Funkhouser addressed the Commission and made some suggestions concerning the adjustment of qualifying contribution amounts and spending limits after the 2002 election (Agenda Item VI.). The Secretary of State has the data to track this information, based on districts, and that data may be obtained on the Secretary of State's website.

  9. Agenda Items for the Next Meeting:

    • Agenda items should be submitted to the Executive Director before the August 13, 2002 Commission Meeting.

  10. The next meeting:

    Tuesday, August 13, 2002, at 9:30 a.m., Citizens Clean Elections Commission, 4001 N. 3rd Street, Suite 200, Phoenix, Arizona 85012.

  11. Adjournment:

    Commissioner Lemon moved to adjourn the Commission meeting, seconded by Commissioner McKay. Motion carried.
