MINUTES OF PUBLIC MEETING OF THE

STATE OF ARIZONA

CITIZENS CLEAN ELECTIONS COMMISSION

June 25, 2002

A public meeting of the Citizens Clean Elections Commission was convened on June 25, 2002, 9:30 a.m., at Citizens Clean Elections Commission, 4001 N. 3rd Street, Suite 200, Phoenix, Arizona 85012

  1. Chairperson Jones called the meeting to order at approximately 9:35 a.m.
     
  2. Approval of the June 4 ,2002 minutes:

    Commissioner McKay moved to approve the June 4, 2002 minutes as presented, seconded by Commissioner Jolley, the June 4, 2002 minutes were approved as presented. Motion carried.

    Announcement:

    • CCEC fund balance is over $15.6 million.
    • To date, the Commission has refunded $109,000 to lobbyists.

  3. Executive Director's Report:

    Executive Director Colleen Connor gave the Executive Director's Report on the following subjects:

    Legislative Matters and Rules:

    • The Court of Appeals ruling on June 17, 2002 reversed the Maricopa County Superior Court decision in the May case. The Court of Appeals ruled that the 10% surcharge on fines is unconstitutional but severable from the rest of the Clean Elections Act.

    Candidate Information:

    • To date, the Commission has distributed $1,728,000 to candidates.
    • There are 255 candidates to be placed on the September ballot as of June 24, 2002.
    • There are 144 certified candidate (30 Statewide and 114 Legislative).

    Voter Education:

    • Candidate Statement Pamphlet
    • Candidate Debates
    • Media Tour

    Enforcement:

    • The staff is beginning to call committees that have incorrectly recorded independent expenditures in their campaign finance software.

  4. Candidate Debates:

    Mr. Bernie Ronan, Director of the Center for Civic Participation, gave a presentation to the Commissioners regarding the Community College's sponsorship of the CCEC debates.

    The Commissioners agreed to allow Mr. Ronan to proceed and work to finalize a contract with the Executive Director.

    Commissioner Lemon moved to give Executive Director Connor the authority to sign a contract with the association to facilitate the debates, seconded by Commissioner Jolley. Motion carried.

  5. Discussion of Candidate Statements Pamphlet:

    Executive Director Connor reviewed the timetable for the production and completion of the Candidate Statement Pamphlet with the Commissioners. There will be 2 mailings of the pamphlet, one before the Primary and one before the General elections.

  6. Legal Report from Assistant Attorney General Todd Lang:

    Assistant Attorney General Todd Lang requested that the Commission go into Executive Session for the purpose of discussing the petition for review of May v Bayless and an amicus brief in the Court of Appeals in the Horne v Molera case.

  7. Preliminary Discussions for Strategic Planning for the 2003-2004 Election Cycle.

    Executive Director Connor reviewed projects scheduled for 2003-2004 with the Commissioners.

  8. Public Comment:

    Cecilia Martinez, Executive Director, Clean Elections Institute

    Ms. Martinez commended the staff, the Commission and Critical Public Relations (CPR) on the fantastic job that was done working very quickly with the media and the candidates after the Appeals Court ruling in the May case was announced.

    Ms. Martinez also hoped that everyone has had the opportunity to hear the Clean Elections Institute's public service announcements featuring Senator John McCain and Corporation Commissioner Marc Spitzer.

    Jessica Funkhouser, Secretary of State, Elections Officer

    Ms. Funkhouser gave the Commission an overview of the Candidate activity being generated at the Secretary of State's Office.

    At this point, Commissioner Lemon moved that the Commission go into Executive Session For the purpose of obtaining legal advice and to discuss the Executive Director's review, seconded by Commissioner McKay. Motion carried.

    Commissioner Lemon moved to end the Executive Session and continue with the open meeting, seconded by Commissioner McKay. Motion carried.

    Commissioner Lemon moved that the Executive Director and Legal Counsel be authorized to file a Petition for Review and a Motion for Stay in the May case, seconded by Commissioner Mckay. Motion carried.

    Commissioner Lemon moved that the Executive Director and Legal Counsel be authorized to forego an amicus brief in the Molera case unless time and availability of resources are united, seconded by Commissioner Jolley. Motion carried.

  9. Agenda Items for the Next Meeting:

    The July 9, 2002 Commission meeting is cancelled. Agenda items will be submitted as needed for the future meeting scheduled July 30, 2002.

  10. The next meeting:

    Tuesday, July 30, 2002, at 9:30 a.m., Citizens Clean Elections Commission, 4001 N. 3rd Street, Suite 200, Phoenix, Arizona 85012.

    Commissioner Lemon moved that this meeting be adjourned, seconded by Commissioner McKay. Motion carried.

  11. Adjournment
