MINUTES OF PUBLIC MEETING OF THE

STATE OF ARIZONA

CITIZENS CLEAN ELECTIONS COMMISSION

June 4, 2002

A public meeting of the Citizens Clean Elections Commission was convened on June 4, 2002, 9:30 a.m., at Citizens Clean Elections Commission, 4001 N. 3rd Street, Suite 200, Phoenix, Arizona 85012

  1. Chairperson Jones called the meeting to order at approximately 9:35 a.m.
     
  2. Approval of the May 21, 2002 minutes:

    Commissioner McKay moved to approve the May 21, 2002 minutes as presented, seconded by Commissioner Lemon, the May 21, 2002 minutes were approved as presented. Motion carried.

    Announcement(s):

    • 145 participating candidates have been certified.
      - 13 Candidates have applied for funding
      - 4 Candidates have received funding
      - 9 Candidates are pending to receive funding

  3. Executive Director's Report:

    Legislative Matters, Rules and Enforcement:

    • Redistricting Matters

      Executive Director Connor announced to the Commission that the redistricting matters have been resolved for the 2002 Election.

    • A complaint was filed by Tom Horne alleging that Jaime Molera violated the officeholder expense rule.
    • Representatives from the U.S. General Accounting Office are present in Arizona to discuss the Arizona Clean Elections Act based on a Congressional mandate.

    At this point in the Executive Director's report, Chairperson Jones requested that the four-member team from The U.S. General Accounting Office introduce themselves to the Commission.

    Voter Education:

    • Training seminars
    • Candidate Statement Pamphlet
    • Candidate Debates

    Public Relations:

    • CPR summer media tour dates are as follows:
      June 13 - Casa Grande
      June 19-21 - Kingman, Bullhead City, Lake Havasu
      June 27 - Pinal County
      July 15 - 16 - Gila Bend, Parker, Yuma
      July 25 - Globe/Miami
      July 31 - August 2 - Flagstaff, Winslow, Holbrook, Show Low and Payson
      August 6-8 - Safford, Douglas, Sierra Vista, Bisbee, Nogales and Tucson

    Budget & Office Operations:

    • Refunds continue to be processed and mailed to Lobbyists who have requested them. To date, $80,900 has been refunded.

  4. Update and Discussion of the 2002 Budget:

    Deputy Director Shaffer reviewed the budget with the Commissioners.

  5. Consideration of Complaint, Response, and Executive Director Recommendation Regarding Molera Campaign:

    Commissioner McKay recused himself from the discussion of the complaint.

    Executive Director Connor reviewed the complaint with the Commissioners and stated her recommendation; that there was no reason to believe the allegations.

    Commissioner Lemon moved to accept the recommendation of the Executive Director; that the Commission find no reason to believe that the respondent Jaime Molera, candidate for Superintendent of Public Instruction, has committed a violation of statute or rule over which the Commission has jurisdiction, be approved, seconded by Commissioner Detrick.
    Motion carried.

  6. Discussion of Questions Regarding Officeholder Expense Accounts:

    Executive Director Connor reviewed the questions asked in regard to the officeholder expense accounts with the Commissioners.

  7. Consideration and Approval of One-Party-Dominant Legislative Districts:

    Executive Director Connor reviewed the one-party-dominant districts for the 2002 election with the Commissioners.

    Commissioner Lemon moved to approve the one-party-dominant districts as presented, seconded by Commissioner McKay. Motion carried.

  8. Call for Public Comment:

    There were no public comments offered at this meeting.

    At this time Commissioner McKay moved to go into Executive Session to discuss personnel matters, seconded by Commissioner Detrick. Motion carried.

    Commissioners moved to end the Executive Session.

  9. Legal Report from Assistant Attorney General Todd Lang.

    Assistant Attorney General Todd Lang reviewed the court's redistricting order with the Commissioners. He also announced that the Attorney General's Office would be attending The State Bar convention in Tucson.

  10. Agenda Items for the Next Meeting:

    • Agenda items should be submitted to the Executive Director before the June 25, 2002 Commission Meeting.

  11. The next meeting:

    Tuesday, June 25, 2002, at 9:30 a.m., Citizens Clean Elections Commission, 4001 N. 3rd Street, Suite 200, Phoenix, Arizona 85012.

    At this time Chairperson Jones asked Ms. Nancy Kawahara, Senior Evaluator with the U.S. General Accounting Office in Los Angeles to speak. Ms. Kawahara gave an overview of their designated task to the Commission.

  12. Adjournment:

    Commissioner Detrick moved to adjourn the regular session of the June 4, 2002 Commission meeting, seconded by Commissioner Jolley. Motion carried.
