- Chairperson Jones called the meeting to order at approximately 9:35 a.m.
- Approval of the March 19, 2002 minutes:
Commissioner Lemon moved to approve the March 19, 2002 minutes as presented, seconded by Commissioner McKay, the March 19, 2002 minutes were approved as presented. Motion carried.
Announcement:
- As of March 31, 2002: the CCEC fund balance was $13,916,906.
- 96 participating candidates have been certified.
- Executive Director's Report:
Executive Director Colleen Connor gave the Executive Director's Report on the following subjects:
Voter Education:
- The Five-Dollar-Bill Campaign
- Media Coverage
- Candidate Statement Pamphlets
- Candidate Debates
Budget and Office Operations:
- The status of the Voter Education and Public Relations Manager position
- Audits of Candidates:
- Commissioner Lemon would like the staff to establish a procedure to do random audits of candidates.
- The issuing of warrants (checks) to candidates:
- The statewide accounting system will not process warrants (checks) on Tuesday nights. Therefore, no state warrants will be available on Wednesdays. However, according to GAO, state warrants can be expedited on Wednesdays if an agency has at least 10 warrants to process.
- Redistricting
Legislative Matters and Rules:
- The 2 Commission bills that passed in the Senate have not yet been assigned in the House.
- Adoption of Surplus Money and Officeholder Expense Rules, A.A.C. R2-20-104 (C) and (G).
The Commissioners discussed the expenditures of candidates for certain items (ie personal computers, cell phones and travel.)
Commissioner Lemon moved to adopt A.A.C. R2-20-104 (C) and (G) as presented, seconded by Commissioner Detrick. Motion carried.
- Consideration of Procedure to Monitor Independent Expenditures.
Executive Director Connor addressed some of the concerns of the Commissioners regarding this issue.
Commissioner Lemon moved to accept the staff's recommendation regarding the monitoring of Independent Expenditures, seconded by Commissioner Detrick. Motion carried.
- Consideration of the Commission Meeting Schedule for July-December 2002.
The Commissioners accepted this schedule with the possibility of additional meetings being added at a later date.
- Consideration of Substantive Policy Statements Regarding Travel Related Expenses and Solicitors of Qualifying Contributions.
Executive Director Connor explained to the Commissioners the background for the Proposed Substantive Policy Statements.
Attorney Lee Miller, of Miller, LaSota and Peters prepared a response to the Proposed Substantive Policy Statements for the Commission's consideration. Executive Director Connor distributed a copy of Mr. Miller's response to the Commissioners. The Commissioners will review Mr. Miller's response and the Proposed Substantive Policy Statements will be on the April 30, 2002 Commission meeting agenda for discussion.
- Update on Bills in Legislature: Consideration of Candidate Statement Pamphlet Prior to General Election, SB 1051, and Other Legislation Effecting Clean Elections.
Executive Director Connor reported to the Commissioners that two of the Commission bills passed in the Senate last week have not yet been assigned in the House.
SB 1051, Consideration of Candidate Statement Pamphlet Prior to the General Election passed in the Senate and would require the Commission to do two separate mailings.
- Discussion to Ascertaining Debate Sponsors.
Executive Director Connor gave the Commissioners an update concerning the debates that already had sponsors. There are still debates that require sponsors.
- Legal Report (Oral Report from Assistant Attorney General Todd Lang).
Assistant Attorney General Todd Lang reported that the Supreme Court declined to review the special action filed by Mr. May challenging the 10% civil and criminal fines and penalties (May v Bayless). The plaintiff filed a special action appeal in the Court of Appeals to get an expedited review. The Attorney General's office has agreed to a stipulation with the plaintiff's attorneys that has been filed with the Maricopa County Superior Court.
- Public Comment:
Cecilia Martinez, Director of the Clean Elections Institute:
Ms. Martinez reported to the Commission the status of a Bills being tracked by the Clean Elections Institute. She also announced some events that the Institute will be hosting. The Institute is very please with the pro-active stance the Commission has taken with regard to independent expenditures. On behalf of the Institute, Ms. Martinez thanked the Commission for upholding the spirit and the letter of the law as well.
Nancy Read, Secretary of State's Office, Campaign Finance Supervisor:
Ms. Read announced that an information election workshop for candidates and treasurers is being held on Wednesday, April 3, 2002. There will be a morning and an afternoon session held at the State Capitol Executive Tower. Deputy Director Matthew Shaffer will be one of the speakers.

Commissioner McKay moved that this meeting be adjourned, seconded by Commissioner Detrick. Motion carried.
