MINUTES OF PUBLIC MEETING OF THE

STATE OF ARIZONA

CITIZENS CLEAN ELECTIONS COMMISSION

MARCH 19, 2002

A public meeting of the Citizens Clean Elections Commission was convened on March 19, 2002, 9:30 a.m., at Citizens Clean Elections Commission, 4001 N. 3rd Street, Suite 200, Phoenix, Arizona 85012

  1. Chairperson Jones called the meeting to order at approximately 9:30 a.m.
     
  2. Approval of the February 19, 2002 minutes:

    Commissioner Lemon moved to approve the February 19, 2002 minutes as presented, seconded by Commissioner McKay, the February 19, 2002 minutes were approved as presented. Motion carried.

    Announcement:

    • Executive Director Connor introduced the new Campaign Finance Assistant, Colleen McGee.
    • Todd Lang, Assistant Attorney General will appear on KAET, Horizon, Wednesday, March 20, 2002, 7:00 p.m. to discuss the Lavis v. Bayless case.
    • CCEC fund balance as of February 28, 2002 was $13,086,610.
    • CCEC has 89 certified participating candidates.
    • Executive Director Connor will be attending a conference in Washington, D.C. from April 4th through 8th. Deputy Director Matt Shaffer will be in charge of the CCEC office.

  3. Executive Director's Report:

    Executive Director Colleen Connor gave the Executive Director's Report on the following subjects:

    Lobbyist Fees:

    • A review of the legal aspects of returning the lobbyist fee
    • The proposed procedure and a cost estimate for the Commission to return the lobbyist fee

    Voter Education:

    • The Five-Dollar-Bill Campaign
    • Renewal of the Advertising and Public Relations Contract

    Budget and Office Operations:

    • The Voter Education and Public Relations Manager position will be advertised
    • Another 80,000 qualifying contribution forms have been ordered bringing the total ordered by the Commission to 465,000
    • Training Seminars for Participating and Non-Participating Candidates will continue
    • SPO approved the contract with Campaign Media Analysis Group (CMAG)

    Legislative Matters and Rules:

    • The Legislature resumed its regular session
    • Commission bills have been scheduled for action in the Senate

  4. Consideration of Refunding the Lobbyist Fee and Procedure:

    Deputy Director Shaffer reviewed the proposed process for refunding the lobbyist fees with the Commissioners. He also explained the process of issuing state warrants (checks).

    Commissioner Lemon moved that Assistant Attorney General, Todd Lang be authorized to stipulate to the return of the lobbyist fees, seconded by Commissioner McKay. Motion carried.

  5. Consideration of Voluntary Termination as a Participating Candidate Procedure.

    Executive Director Connor explained to the Commissioners the procedure used when a candidate voluntarily terminates as a participating candidate. She also explained that the Commissioners may be called in the future to consult on a voluntary termination when one is requested.

  6. Discussion of the Following Enforcement Procedures and Rules:
     
    1. Monitoring of Independent Expenditures.

      Executive Director Connor discussed independent expenditures with the Commissioners.
      The Commissioners will review the procedure and it will be discussed, in detail, at the April 2, 2002 Commission meeting.

    2. Proposed Article 2 Rule Changes

      Executive Director Connor explained the steps followed in the enforcement procedure:

      1. A Complaint
      2. Alleged Violator's Response
      3. Reasons to Believe Findings
      4. Probable Cause of Findings
      5. Right to Appeal

    Commissioner Lemon moved to adopt the Enforcement Procedure as presented with the exception of the proposed enforcement priority ranking, seconded by Commissioner McKay. Motion carried.
     
  7. Update on Bills in Legislature.

    Executive Director Connor will report to the Commissioners the complete results of all bills affecting CCEC at the April 2, 2002 Commission meeting.

  8. Use of Assistance of Consulting Firm and Budget Implications.

    Executive Director Connor explained to the Commissioners the proposed extension of the proposed advertising contract.

    Commissioner Detrick moved to extend the advertising contract with L3 and CPR as proposed by staff, seconded by Commissioner McKay. Motion carried.

  9. Legal Report (Oral Report from Assistant Attorney General Todd Lang).

    Assistant Attorney General Todd Lang stated that there was nothing to report.

  10. Discussion of Strategic Planning and Commission Committees for 2002.

    Chairperson Jones reviewed with the Commissioners the proposed Commission Committees for 2002. Each Commissioner will assist a staff member with respect to the Commission's operations.

  11. Public Comment:

    No public comments were given at this meeting

  12. Agenda Items for the Next Meeting:

    Final Adoption of the Office Holder Expense Rule
    Substantive Policy Statement Regarding the Reporting of Travel-Related Expenses and Solicitors
    Consideration of Commission Meeting Schedule for July through December 2002

  13. The next meeting:

    Tuesday, April 2, 2002 at 9:30 a.m., Citizens Clean Elections Commission, 4001 N. 3rd Street, Suite 200, Phoenix, Arizona 85012.

    Commissioner McKay moved that this meeting be adjourned, seconded by Commissioner Jolley. Motion carried.
