- Chairperson Jones, called the meeting to order at approximately 9:35 a.m.
- Approval of the January 29, 2002 minutes:
Commissioner Detrick moved to approve the January 29, 2002 minutes as presented, seconded by Commissioner Lemon, the January 29, 2002 minutes were approved. Motion carried.
Announcement:
CCEC Fund Balance as of January 31, 2002 was $12,729,592.
- Executive Director's Report:
Executive Director Colleen Connor gave the Executive Director's Report on the following subjects:
- Voter Education:
The Candidate Statement Procedure
The Debate Procedure
The Five-Dollar-Bill Campaign Signs
The Advertising and Public Relations Contract
- Budget and Office Operations:
Estimated and Actual 2001Arizona Resident Personal Income Tax Returns Filed
- Legislative Matters and Rules:
SB 1051, Voter Education Mailing
HB 1286, Supplemental Filing of Qualifying Contributions
- Consideration of Application for Funding Procedure:
- Presentation by Secretary of State's Office Regarding Duties of the Secretary of State and the County Recorders for verification of $5 qualifying contributions.
Director Jessica Funkhouser, from the Elections Department of the Secretary of State's office gave an informative slide presentation on the duties of the Secretary of State and the County Recorders for the verification of $5 qualifying contributions.
- Update on Cost of Obtaining Voter Registration Data:
Executive Director Connor addressed the Commission and gave an overview on the availability and cost for obtaining voter registration data.
At this point in the meeting, Commissioner Lemon moved that the Commissioners go into Executive Session to obtain legal counsel from Assistant Attorney General Todd Lang, seconded by Commissioner McKay. Motion Carried.
Chairperson Jones called the regular session back to order.
- Consideration of Procedure for One Chance to Apply for Funding:
Deputy Director Matt Shaffer discussed the 2000 Election statistics and the percentage of approval for candidates regarding their applications for funding and the number of $5 qualifying contributions submitted.
The Commissioners had a discussion regarding R2-20-105 (E). The Commissioners suggested changing the wording in R2-20-105 (E) to make it clear as to what thresholds would be used to allow for one supplemental submission of $5 qualifying contributions.
Commissioner Lemon moved to approve R2-20-105, Certification for Funding as presented with the exception that the language in R2-20-105 (E) be changed, seconded by Commissioner Detrick. Motion carried.
- Consideration of Rule for Application for Certification to be filed by January 31st and Proposed Substantive Policy Statement.
Commissioner Lemon moved to adopt the Rule for Application for Certification to be filed by January 31st and the Proposed Substantive Policy Statement as presented, seconded by Commissioner McKay. Motion carried.
Commissioner Jolley abstained in this vote.
- Debate Application Procedure.
Chairperson Jones moved to go into Executive Session for legal counsel, seconded by Commissioner McKay. Motion carried.
Chairperson Jones called the general session back to order.
Commissioner Lemon moved to approve items 1 through 9 of the Debate Application Procedure as presented, seconded by Commissioner Detrick. Motion carried.
- Consideration and Approval of No Action Letter Procedure and Qualifying Contribution Form created by Bayless for Governor Committee.
Executive Director Connor discussed this agenda item with the Commissioners explaining the process in detail.
A no action letter will be a determination from the staff that will either not recommend an enforcement action or cannot assure that the course of action and conduct will not be referred for enforcement. A copy of the request for a no action letter and the response will then be sent to the Commissioners.
- Update on Bills in Legislature: Consideration of Candidate Statement Pamphlet Prior to General Election, SB1051, and Other Legislation Effecting Clean Elections:
- SB 1051, Voter Education Mailing - This bill passed through the Government Committee on Monday, February 4, 2002 .
- SB 1286, Supplemental filing of Qualifying Contributions - This bill passed through the Senate Government Committee on Monday, February 11, 2002.
Executive Director Connor stated to the Commission that staff will continue to work on the Candidate Statement process and the possibility of a second mailing in the General Election. This issue will be addressed again in a future Commission meeting.
- Use of Assistance of Consulting Firm and Budget Implications.
Commissioner Lemon moved to extend the consulting firm's contract through April, 2002, seconded by Commissioner Detrick. Motion carried.
Commissioner Lemon then requested that the staff explore, with the current contractor, the cost of keeping the $5 campaign alive. He would also like the staff to explore the use of the PR firm for reviewing press releases, seconded by Commissioner Detrick. Motion carried.
This issue will be addressed in a future Commission meeting.
- Legal Report (Oral Report from Assistant Attorney General Todd Lang).
Assistant Attorney General Todd Lang stated he did not have anything new to report at this meeting
- Public Comment:
Cecilia Martinez, Executive Director, Clean Elections Institute
Cecilia Martinez wanted to thank the Commission and staff for their support of the Two Bites at the Apple Bill. She stated that 150 people attended a Clean Elections Rally held at the Capitol in support of the Clean Elections Act. The rally was sponsored by the Clean Elections Institute.
Carol Mattoon, League of Women Voters
Carol Mattoon addressed the Commission and stated that she was happy that the staff and Commission supported the Two Bites at the Apple Bill. She asked the Commission to continue the public relations campaign and she also asked the Commissioners to explore different vendors. Ms. Mattoon stated the League has created a new flyer that the League of Women Voters will distribute in support of the Clean Elections Act.
